The Tipping Point CVBA (‘TTP’) places great importance on protecting your personal data. This statement has been drafted in accordance with Regulation (EU) 2016/679 of the European Parliament and the Council of April 26, 2016, concerning the protection of natural persons regarding the processing of personal data. Its purpose is to guarantee adequate protection of personal data and clarify the rights of every user.

Below, you will find all the information about which personal data TTP processes and how TTP handles this data appropriately:

1. Scope

TTP receives and processes certain data from you during your interactions with TTP, its appointees, employees, or via the website www.thetippingpoint.be. Since this data allows us to directly or indirectly identify you, it is classified as ‘personal data,’ which entitles you to protection and the ability to exercise certain rights. This Privacy Policy applies to all personal data that TTP receives from clients, potential clients, website visitors, newsletter subscribers, and participants in our training programs (both natural and legal persons), except for the cookie policy. The cookie policy is addressed separately and can be found at www.thetippingpoint.be or provided upon request. By using TTP’s services or products, you generally agree to the acceptance of this Privacy Policy. This consent is also explicitly granted whenever you use TTP’s services or provide us with personal data.

2. Personal Data Held by TTP

TTP receives, collects, and processes the following personal data, which may include but is not limited to:

  • – For registering for (offline or online) sessions and training programs: email address, phone number, first name, last name, job title, and the organization where you are employed.
  • For purchases made through the webshop: email address, phone number, first name, last name, job title, organization of employment, VAT number, Chamber of Commerce (KVK) or Crossroads Bank for Enterprises (KBO) number, country, and shipping address.
  • For subscribing to the (electronic) newsletter or equivalent communications: email address, phone number, first name, last name, job title, and the organization of employment.
  • Via email or direct contact (physical or online): email address, phone number, first name, last name, job title, and the organization of employment.

3. Processing of Personal Data

TTP processes personal data for the following purposes:

  • Establishing and efficiently executing agreements for providing specific services (such as participation in training programs or sessions, delivering (digital) content, reports, or other relevant information, and processing orders for products and/or services while identifying the participant or recipient).
  • Billing purposes and following up on these invoices.
  • Sending targeted advertisements, newsletters, and other potentially relevant marketing information about TTP and its services (including future training programs and sessions).
  • Continuous improvement, maintenance, and optimization of products, services, (mobile) websites, and their security, as well as enhancing TTP’s general, commercial, and marketing strategies.
  • Personalizing the products and/or services provided to you and their associated support services, usage information, service notifications, or related (electronic) messages.
  • Compliance with applicable legislation concerning TTP.

4. Storage and Security

TTP will not retain your data longer than necessary for processing it for the purposes stated above, considering the need to answer user queries accurately, deliver or promote services or products, improve product and service quality, and meet its legal obligations, particularly in maintaining accurate accounting records. Generally, data is retained for up to 5 years after its last use. Personal data may be deleted earlier at the user’s explicit request.

Users accept that their personal data may be retained even after completing and ending a learning path, session, or other training programs, as well as after any webshop purchase, for the purposes outlined above (especially newsletters and marketing purposes). This does not affect the user’s rights to correct, modify, or delete this data.

TTP processes and stores personal data in specific IT systems, such as servers hosted by third parties, internal CRM systems, and platforms like MailChimp or similar storage systems. To best protect your personal data, TTP takes reasonable and appropriate measures—potentially in collaboration with external contractors—that comply with IT standards to prevent unauthorized access, disclosure, misuse, or alteration of personal data.

Employees and, where applicable, external contractors who process or may access your personal data are bound by strict confidentiality obligations and legal professional secrecy. Measures are in place to protect against viruses, malware, and unauthorized access to IT systems and to ensure regular data backups.

Payment data is always protected in accordance with encryption standards commonly used to safeguard sensitive financial information, as provided by TTP’s vendors. TTP does not process payment data directly when you make purchases via the webshop.

5. Sharing of Personal Data

As a general rule, TTP does not share any processed personal data with third parties without your explicit consent, nor does it share data with countries, organizations, or companies outside the European Economic Area.

Personal data may only be shared with TTP contractors when processing by these third parties is necessary for creating, executing, using, purchasing, accessing, or handling products, services, (mobile) websites, or webshops. Agreements are in place with these contractors to restrict the use and processing of personal data and to guarantee sufficient protection.

6. Your Rights as a User

If TTP processes your personal data, you have the following rights as a user:

  • The right to access this data.
  • The right to correct this data if it contains errors or no longer corresponds to reality.
  • The right to withdraw your consent for processing this data, particularly for the purpose of sending advertisements, newsletters, and other potentially relevant marketing information about TTP and its services (including future training programs and sessions).
  • The right to request the deletion of your data (‘right to be forgotten’), particularly if this data is no longer necessary for fulfilling an agreement or if no other legal basis exists for its processing.
  • The right to restrict processing or request data portability.

7. Complaints

If you believe your rights as a user of personal data are being violated by TTP, you should first contact TTP, clearly stating the personal data involved and the reason and legal basis for any alleged violation. TTP will attempt to provide a reasoned response within 15 business days. TTP reserves the right to request additional information from you if necessary to accurately identify the complainant.
