Privacy Policy

The Tipping Point CVBA (‘TTP’) attaches great importance to the protection of your personal data. This statement was prepared in application of Regulation (EU) 2016/679 of the European Parliament and of the Council of 26 April 2016 on the protection of individuals with regard to the processing of personal data. It aims to ensure adequate protection of personal data and clarify the rights for each user.

All information on what personal data TTP processes and how TTP handles it correctly can be found below:

 

  1. Scope

TTP receives and processes certain data from you during your contacts with TTP, its appointees or employees, or via the website www.thetippingpoint.be. As this data allows us to identify you directly or indirectly, it is ‘personal data’ for which you enjoy protection and over which you may exercise certain rights.

This Privacy Policy applies to all personal data that TTP receives from clients, potential clients, visitors to our website, readers of our newsletter and participants in our training courses (both natural and legal persons), with the exception of the policy on cookies. This is the subject of a separate Cookie Policy, available at www.thetippingpoint.be, and can be sent to you upon first request.

By using the services or products of TTP, you agree in principle to accept this Privacy Policy and to acquaint yourself with it. You also expressly grant this consent each time you use the services of TTP or when you provide us with certain personal data.

 

 

  1. Personal data held by TTP

TTP receives and subsequently collects and processes the following personal data. These include:

  • for registering for (offline or online) sessions and training courses: email address, telephone number, first name, name, position and the organisation where you are employed;
  • for purchases on the web shop: e-mail address, telephone number, first name, name, function and the organisation where you are employed, as well as possibly the VAT number, Chamber of Commerce or KBO number, country and address of shipment;
  • for subscribing to the (electronic) newsletter or equivalent communications: e-mail address, telephone number, first name, surname, position and the organisation where you are employed
  • via e-mail or direct (physical or online) contact: e-mail address, telephone number, first name, name, position and the organisation where you are employed.

 

  1. Processing of personal data

TTP processes these personal data for the following purposes:

  • The conclusion and correct and efficient performance of an agreement for the provision of certain services (such as participation in training courses or sessions, delivery of (digital) content, reports or other relevant information, ordering products and/or services and identifying the participant or addressee)
  • For invoicing purposes and the follow-up and collection of these invoices;
  • To send advertisements, newsletters and other potentially relevant marketing information about TTP and its services (such as in particular future training courses and sessions) directly and optimally tailored to you;
  • The continuous improvement, maintenance and optimisation of our products, services, (mobile) websites, and their security, as well as the optimisation of TTP’s general, commercial and marketing strategies;
  • The personalisation of the products and/or services to be provided to you and related support services, usage information, service messages or other related (electronic) messages;
  • Compliance with legislation applicable to TTP in the broadest sense;

 

  1. Retention and Security.

TTP will not retain your data for longer than necessary to process it for the above purposes, taking into account the need to correctly respond to user queries, to provide or promote the services or products, to improve the quality of the products and services and to comply with its own legal obligations, in particular for keeping accurate accounts. In general, data are kept for a maximum of 5 years, after last use. Only at the explicit request of the user will personal data be deleted before expiry of the aforementioned period.

The user accepts that his personal data may also be stored for the above purposes (in particular for newsletters and marketing purposes) after following and completing a learning programme, session or any other training course, as well as after any purchase through the webshop. This does not affect the user’s rights to correct, amend or delete such data.

The user of TTP’s services accepts that this data is processed and stored on certain IT systems, such as a server hosted by TTP with a third party, an internal CRM system as well as with MailChimp or similar storage systems. In order to protect your personal data in the best possible way, TTP, possibly together with external contractors, will take all reasonable and appropriate measures that apply as the normal standard within IT to prevent external access, disclosure, misuse or alteration of this personal data.

The employees and possibly external contractors of TTP who process or access your personal data are bound by a strict obligation of confidentiality and legal professional secrecy. To ensure the security, confidentiality and integrity of your personal data, we ensure that we are protected against antivirus, malware and other attempted unauthorised access on the above IT systems, as well as backup of this personal data.

Payment data is always protected in accordance with the standard encryptions commonly used to protect sensitive financial information and provided by TTP’s suppliers – TTP itself does not process payment data if you make purchases via the webshop.

 

  1. Sharing of personal data

As a general rule, TTP does not share any of the personal data processed with third parties without your explicit consent, nor does it share such data with countries, organisations or companies located outside the European Economic Area.

Personal data may only be shared with contractors of TTP where the processing by these third parties is necessary for the establishment, implementation, use, purchase, access or handling in relation to products, services, (mobile) websites, or web shops. Appropriate agreements have always been concluded with these contractors that restrict the use and processing of your personal data and guarantee adequate protection of your personal data.

 

  1. Your rights as a user

If TTP processes your personal data, you have the following rights as a user:

  • The right to access this data
  • The right to correct this data if it contains material errors or no longer corresponds to reality
  • The right to withdraw your consent to the processing of these data, in particular for the purpose of sending advertisements, newsletters and other potentially relevant marketing information about TTP and its services (such as, in particular, future training courses and sessions);
  • The right to data erasure (right to oblivion), in particular if such data are no longer necessary for the proper performance of the contract or if there is no longer any other legal basis for the processing
  • The right to restriction of processing or transferability of personal data.

 

  1. Complaint

If you believe that your rights as a user of personal data have been violated by TTP, you should first contact TTP about this, clearly stating the personal data concerned and the reason and legal basis for any violation. TTP will endeavour to provide a reasoned reply within 15 working days. TTP reserves the right to require further information from you for the handling of the complaint, if this is necessary for the correct identification of the complainant.

If you believe that the response or the solution proposed by TTP is not adequate, you have the right to lodge a complaint with the Data Protection Authority:
